DEP IGNORES Big Cypress Opinion

As we had anticipated, the Florida Department of Environmental Protection has notified Judge Alexander and the Florida Division of Administrative Hearings that it intends to ignore the recommendations of the Big Cypress Swamp Advisory Committee to deny the Golden Gate oil well permit.

Undersigned counsel has conferred with Danielle H. Irwin, the Deputy Director of the Division of Water Resource Management, to determine the position of the Department’s staff in response to the Committee’s recommendation. The Department’s staff believes that the Committee’s observations are generally beyond the Department’s purview in its consideration of the pending application. The Department further believes that there is no basis, under its existing regulatory authority, to deny the application. Therefore, the Department does not propose any change in its position at the present time. Undersigned counsel requests a status conference during the week of April 21 to address the matters in this notice.

How can the FDEP ignore the recommendations of the Governor’s own scientific advisory panel??? Write Gov. Scott and ask him:
